For voluntary participation with Fans First Entertainment, LLC (dba Savannah Bananas), its related events and activities. Read the full agreement below, then sign electronically.

What you are agreeing to

  • Assumption of risk. The risk of injury and illness from participation may be significant, up to permanent paralysis and death. You voluntarily assume all risks, known and unknown, and take full responsibility for your participation.
  • Hazards. You agree to comply with the stated terms of participation, and to remove yourself and notify the company immediately if you observe any unusual or significant hazard.
  • Release and indemnity. For yourself and your heirs, you release and hold harmless the company, the host venue, and their agents, partners, vendors, employees, and insurers from all claims, including injury, property damage, medical expenses, illness, disability, and death, arising from your voluntary presence at Grayson Stadium or a host venue.
  • Limits. This waiver does not release the company from liability for its own intentional misconduct or gross negligence.
  • Medical consent. You consent to medical treatment deemed advisable in the event of injury, accident, or illness during any company event.
  • Photo and data release. You may be photographed or recorded, and consent to that use without compensation. Event data may be collected and used per company data-privacy policies.

By signing, you certify you have read and understood this agreement, sign freely and competently, and are at least 18 years of age. You had sufficient time to review and consult counsel.

 In consideration of being allowed to VOLUNTARILY participate in any way with Fans First Entertainment, LLC, (dba Savannah Bananas) (the “COMPANY”) its related events and activities, the undersigned acknowledges, appreciates, and agrees as follows: 

  • The risk of injury and illness associated with MY participation in this program MAY BE significant, including the potential for permanent paralysis and death. While particular skills, equipment, and personal discipline may reduce this risk, I UNDERSTAND FULLY the risk that serious injury still exists. 
  • I VOLUNTARILY, knowingly and freely assume all such risks, both known and unknown, associated with participating and/or volunteering in any event held by the COMPANY, even if arising from the negligence of the OTHER PARTICIPANTS, Releasees or others, and assume full responsibility for my participation. 
  • I willingly agree to comply with the stated and customary terms and conditions for VOLUNTARY participation. If, however, I observe any unusual or significant hazard during my presence or participation, I will remove myself from participation and immediately notify the COMPANY of the situation. 
  • I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin (collectively  “Releasors”), hereby release, indemnify, and hold harmless  COMPANY, its and location venue (“HOST”),  HOST’S agents, affiliates, strategic partners, approved vendors, employees, insurers, successors, and assigns (collectively  “Releases”) from any and all claims, demands, causes of action, damages, or lawsuits and equity of any kind. This includes but is not limited to claims for personal injury, loss or damage to person or property, medical expenses, illness, disability, and loss of services, or death arising out of or in any way related to my VOLUNTARY presence or involvement at GRAYSON STADIUM, (“COMPANY’S VENUE”) OR, IF BEING HOSTED AT ANOTHER VENUE, (“HOST’S VENUE”). The risks include, but are not limited to, those caused by terrain, facilities, temperature, acts of God, weather, equipment (including drones), vehicular traffic, and the actions of other people, including but not limited to other participants and volunteers. I acknowledge that if I bring any legal action against the Releasees or any of them, I will be in breach of this Release of Liability Agreement. 
  • This waiver and release is intended to release the COMPANY from any and all liability for damages or injuries arising from or related to my negligence, including the negligence of third parties. However, this waiver does not release the COMPANY from liability resulting from their own intentional misconduct or GROSS negligence. 
  • I hereby consent to receive medical treatment that may be deemed advisable in the event of injury, accident, or illness during any event held by the COMPANY. 
  • I understand that at any event or related activity with the COMPANY, I and my Releasors may be photographed or recorded. I agree to allow my photo, video, or film likeness to be used for legitimate purposes by the COMPANY and all entities being released. Furthermore, I understand that no royalty, fee, or other compensation will be payable to me or my Releasors for such use. 
  • I understand that data may be collected during this event. I agree to release said data to the COMPANY and its affiliates for use in accordance with their business practices and in compliance with the COMPANY’S data privacy policies. 
  • I acknowledge that I have had sufficient time to read this entire document and, should I choose to do so, consult with legal counsel prior to signing. I agree to fully comply with all standard rules and regulations regarding the use of COMPANY’S  VENUE OR HOST’S VENUE. 

I have read and understood this Agreement, and by signing it, I consent to be bound by its terms, including the waiver and release of any legal rights I may have to sue the COMPANY for any costs they incur as a result of a claim or legal action brought in violation of this Agreement. This Agreement shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I agree that any violation of the terms and conditions of this Agreement, as determined by the COMPANY, will be considered a breach of the Agreement. 

I hereby certify that I have read this document, understand its content, and am signing this Agreement freely, voluntarily, and competently. I affirm that I am at least eighteen (18) years of age.

Parent/Guardian Waiver for Minors (Under 18 Years Old) The undersigned parent and/or legal guardian hereby represents that he/she is acting in such capacity and is fully responsible for and agrees to save, hold harmless, and indemnify each and all of the parties referred to above from any liability, loss, cost, claim, or damage whatsoever that may be imposed upon said parties due to any defect in, or lack of, the undersigned's capacity to act in this role. The undersigned also releases said parties on behalf of the minor and the parents or legal guardian. Additionally, the undersigned acknowledges and agrees to all the terms and conditions of the waiver and release set forth above, on behalf of the minor, and understands that they are bound by the same terms.
